1. Acceptance of Terms

By downloading, installing, accessing, or using Guard.Krd (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.

Guard.Krd reserves the right to modify these Terms at any time. We will provide notice of any material changes through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

2. Description of Service

Guard.Krd is an AI-powered anti-cheat solution designed for FiveM servers. The Service monitors game activity to detect and prevent cheating in online gaming environments. Our technology uses real-time monitoring and artificial intelligence to identify unauthorized software and cheating behavior.

Process Monitoring: Our Service actively monitors the processes running on your PC to detect any type of cheat software. This monitoring is designed to identify potentially harmful or unauthorized applications that may be used to gain unfair advantages in games.

Game Process Integrity Checks: At regular intervals, our Service checks the game process to detect any injected binaries or unauthorized modifications that could be used for cheating purposes.

3. License and Restrictions

Subject to these Terms, Guard.Krd grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Service for your personal, non-commercial use. You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Distribute, sell, lease, rent, or sublicense the Service
  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Remove, alter, or obscure any proprietary notice or label on the Service
  • Attempt to circumvent, disable, or otherwise interfere with security-related features of the Service
  • Use the Service to develop competing products or services
  • Interfere with or attempt to disable the process monitoring or game integrity check features

4. Privacy and Data Collection

Our Privacy Policy, available at guard.krd/privacy, describes how we collect, use, and share information about you when you use the Service. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

5. Steam Integration

The Service requires integration with Steam. Your use of Steam is subject to Steam's terms of service and privacy policy. Guard.Krd is not responsible for the privacy practices or content of Steam.

6. User Content and Conduct

You are solely responsible for your conduct while using the Service. You agree not to:

  • Use cheats, automation software, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service or any game experience
  • Use exploits, bugs, or problems in the Service to gain unfair advantage
  • Use the Service in a manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service
  • Attempt to circumvent any content filtering techniques, security measures, or access controls that Guard.Krd employs
  • Use software or methods to block, disable, or interfere with our process monitoring or game integrity checks

7. Enforcement Actions

Guard.Krd reserves the right to take appropriate enforcement actions, including but not limited to banning users, if it determines, in its sole discretion, that a user has violated these Terms or has engaged in behavior that is harmful to other users, to Guard.Krd, or to third parties.

Server administrators using the Service have the authority to enforce their own server rules and may issue bans or other enforcement actions against users of their servers who violate these Terms or server-specific rules.

8. Intellectual Property Rights

The Service, including all content, features, and functionality, is owned by Guard.Krd and is protected by copyright, trademark, and other intellectual property laws. You acknowledge that all intellectual property rights in the Service belong to Guard.Krd or its licensors.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, GUARD.KRD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GUARD.KRD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUARD.KRD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL GUARD.KRD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO GUARD.KRD, IF ANY, FOR ACCESS TO OR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Guard.Krd and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right or privacy right
  • Any claim that your conduct caused damage to a third party

12. Termination

Guard.Krd may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kurdistan Region, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of Kurdistan Region.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
